Terms & Conditions

1. Introduction

1.1 These Terms & Conditions ("Terms") govern your access to and use of thecaviarbutler.com ("Website"), operated by The Caviar Butler Ltd ("The Caviar Butler", "we", "our" or "us"), a company incorporated in England and Wales.

1.2 These Terms apply to users accessing our Website from the United Kingdom, European Union, United States and other territories in which our Website or services are available.

1.3 By accessing or using this Website, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Website.

1.4 These Terms should be read together with any other policies or terms published on our Website, including our Privacy Policy, Cancellation Policy and any terms applicable to a particular booking, purchase or service.

1.5 Where you make an enquiry or booking with us, your quotation, booking confirmation, event agreement and any applicable booking or cancellation terms may form part of your agreement with us.

1.6 If there is any conflict between these Website Terms and a specific written agreement entered into between you and The Caviar Butler for an event or service, the specific written agreement will take precedence in relation to that booking.

1.7 We may update these Terms from time to time. Any updated version will be published on this Website with a revised effective date. Changes will not retrospectively alter an existing confirmed booking unless permitted by law or agreed between us.

2. Use of the Website

2.1 The Website is intended for persons aged 18 or over. If you are under 18, you may only use the Website with the involvement and consent of a parent or legal guardian.

2.2 You agree to use the Website only for lawful purposes.

2.3 You must not:

  • use the Website for fraudulent, unlawful, abusive or harmful purposes;

  • attempt to gain unauthorised access to the Website, its servers, systems or data;

  • interfere with the proper operation or security of the Website;

  • introduce viruses, malicious software or other harmful technology;

  • scrape, copy or systematically extract Website content without our permission;

  • impersonate another person or provide deliberately false information; or

  • use the Website in a way that infringes the rights of The Caviar Butler or any third party.

2.4 We may restrict, suspend or terminate access to the Website where we reasonably believe these Terms have been breached, where necessary for security or legal reasons, or where necessary to protect our business, customers or other users.

3. International Availability

3.1 The Caviar Butler provides services internationally, including in the United Kingdom, European Union and United States.

3.2 Availability of particular services, products, event formats, caviar, food products or other offerings may vary depending on the country, state, region or location of an event.

3.3 The fact that a service or product is displayed on our Website does not guarantee that it is available in every territory.

3.4 Certain services may be subject to local licensing, import, food safety, venue, insurance, customs or other regulatory requirements. We reserve the right not to offer or accept a particular booking where we reasonably determine that we cannot lawfully or appropriately provide the requested service in the relevant location.

3.5 Where additional local requirements materially affect a booking, we will communicate any relevant changes, requirements or costs before the booking is confirmed wherever reasonably practicable.

4. Intellectual Property

4.1 Unless otherwise stated, the Website and its content, including its design, branding, photographs, videos, text, graphics, logos, service descriptions and other materials, are owned by, licensed to, or used with permission by The Caviar Butler.

4.2 Some photographs, videos, fonts, graphics or other materials may be owned by third parties and used by us under licence or with permission.

4.3 Nothing in these Terms transfers ownership of any intellectual property rights to you.

4.4 You may view and use the Website for personal or legitimate business purposes relating to an enquiry or booking with us.

4.5 You may not reproduce, copy, modify, distribute, sell, commercially exploit or republish substantial parts of our Website or branding without our prior written permission, except where permitted by law.

4.6 "The Caviar Butler", our logos, branding and associated visual identity may not be used in a way that suggests an association, partnership or endorsement without our prior written permission.

5. Enquiries, Quotes & Bookings

5.1 Information displayed on the Website is provided for general information and does not constitute a binding offer by us to provide a particular service.

5.2 Event pricing may vary depending on factors including the event location, date, number of guests, service duration, staffing requirements, caviar selection, travel, accommodation, equipment and other event-specific requirements.

5.3 Where prices are not displayed directly on the Website, we will provide an individual quotation based on the information supplied to us.

5.4 Quotations may be provided in GBP, EUR, USD or another agreed currency depending on the location and circumstances of the booking.

5.5 Unless specifically stated otherwise, submitting an enquiry, completing an enquiry form or requesting a quotation does not create a binding booking.

5.6 A booking becomes confirmed only when:

  • we have accepted the booking;

  • any required agreement or booking confirmation has been accepted;

  • the required deposit or payment has been received; and

  • any other conditions specified in the quotation or booking confirmation have been satisfied.

5.7 Until a booking has been confirmed, dates, staff and availability are not guaranteed.

5.8 We may decline an enquiry or proposed booking before it has been accepted by us, including where we do not have availability, cannot meet the requested requirements, cannot lawfully provide the service in the relevant location, or reasonably consider the booking unsuitable for our services.

5.9 Once a booking has been confirmed, any cancellation or alteration by either party will be governed by the applicable booking agreement and our Cancellation Policy.

6. Payments

6.1 Payments must be made using the payment method specified by us, which may include bank transfer, card payment or a designated third-party payment provider.

6.2 Where a deposit or advance payment is required, the amount and payment deadline will be stated in your quotation, invoice, booking confirmation or applicable booking terms.

6.3 The treatment of deposits, cancellations, refunds, changes and outstanding balances is governed by our applicable Cancellation Policy and booking terms.

6.4 You are responsible for ensuring that payment information provided by you is accurate and that payments are made by the applicable deadline.

6.5 Where permitted by applicable law and our applicable payment terms, overdue amounts may be subject to interest, recovery costs or late payment charges.

6.6 Any applicable taxes, duties or other charges will be dealt with in accordance with the quotation, invoice and applicable law.

7. Products and Additional Services

7.1 Where products are offered for purchase through the Website, availability, delivery destinations and applicable purchasing terms may vary by territory.

7.2 Product purchases may be subject to additional terms displayed at the time of purchase, including applicable delivery, refund, cancellation, storage and returns policies.

7.3 Nothing in these Terms removes any statutory rights available to consumers which cannot lawfully be excluded or restricted.

8. Information Provided by You

8.1 You are responsible for providing accurate information when making an enquiry, requesting a quote, purchasing a product or arranging an event.

8.2 This may include information concerning:

  • event location;

  • event date and timings;

  • expected number of guests;

  • venue requirements and access;

  • dietary or allergy information communicated to us;

  • contact and billing information; and

  • any other information reasonably required for us to provide our services.

8.3 If information provided to us changes, you should notify us as soon as reasonably possible.

8.4 Material changes to an event may affect availability, staffing, pricing, logistics or our ability to provide the agreed service and will be handled in accordance with the applicable booking terms.

9. Website Availability and Accuracy

9.1 We aim to keep the Website accurate and available but do not guarantee that it will always be uninterrupted, completely error-free or continuously available.

9.2 We may temporarily suspend, withdraw, update or change parts of the Website for maintenance, security, operational or business reasons.

9.3 Images, descriptions and examples displayed on the Website are intended to represent our services but individual events may vary depending on the venue, location, availability, event requirements and agreed package.

9.4 Where there is a difference between general information displayed on the Website and the specifications contained in your confirmed quotation or event agreement, the confirmed quotation or event agreement will take precedence for that booking.

10. Third-Party Websites and Services

10.1 Our Website may contain links to third-party websites, social media platforms, payment providers or other external services.

10.2 These third-party services are not controlled by us and are subject to their own terms, policies and privacy practices.

10.3 The inclusion of a link does not necessarily mean that we endorse or accept responsibility for the third-party website or service.

11. Liability

11.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

11.2 In particular, nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence where liability cannot legally be excluded;

  • fraud or fraudulent misrepresentation; or

  • any consumer right, statutory protection or other liability which cannot legally be excluded or restricted.

11.3 If you are a consumer, you retain all rights and remedies provided by applicable consumer protection law.

11.4 These Website Terms do not replace or reduce any specific obligations that we have accepted under a confirmed event agreement or other contract with you.

11.5 We are not responsible for loss or damage resulting solely from circumstances outside our reasonable control where we are not legally responsible for that loss or damage.

11.6 If you use this Website for business purposes, then, to the maximum extent permitted by applicable law, we will not be responsible for indirect or consequential business losses arising solely from your use or inability to use the Website, including loss of profits, business opportunities, anticipated savings or goodwill.

11.7 Any limitations of liability applying specifically to an event, service or commercial booking will be set out in the relevant booking agreement or other applicable terms.

12. Consumer Rights

12.1 Nothing in these Terms is intended to remove, restrict or replace rights that a consumer is entitled to under mandatory applicable law.

12.2 United Kingdom consumers: Nothing in these Terms affects statutory consumer rights available under applicable UK law.

12.3 European Union consumers: Where mandatory consumer protection laws of an EU Member State apply to you, these Terms do not deprive you of protections that cannot lawfully be excluded by choosing another country's law.

12.4 United States consumers: Where federal, state or local consumer protection laws provide rights that cannot legally be waived or restricted by contract, those rights will continue to apply.

12.5 If any provision of these Terms conflicts with a mandatory consumer protection law applicable to you, the mandatory legal protection will apply to the extent of that conflict.

13. Privacy and Data Protection

13.1 Personal information collected through the Website is handled in accordance with our Privacy Policy and applicable data protection laws.

13.2 Our Privacy Policy explains what information we collect, why we collect it, how it is used, the circumstances in which it may be shared and the rights available to individuals.

13.3 Where required, additional privacy rights or notices may apply depending on your country, state or territory.

14. Other Policies

14.1 Additional policies published on our Website may apply to your use of our Website, purchase or booking, including where applicable our:

  • Privacy Policy;

  • Cookie Policy;

  • Cancellation Policy;

  • payment and late payment terms;

  • delivery or returns terms; and

  • any event-specific terms or booking agreement.

14.2 These policies form part of the applicable contractual framework where they are expressly incorporated into a booking, purchase or other agreement.

15. Governing Law and Jurisdiction

15.1 These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales, subject to any mandatory laws which apply and cannot legally be excluded.

15.2 Business Customers. If you are entering into an agreement with us wholly or mainly for purposes relating to your trade, business, craft or profession, the courts of England and Wales shall have exclusive jurisdiction over disputes arising from or relating to these Terms, unless a specific written agreement between us provides otherwise.

15.3 Consumers. If you are a consumer, the choice of England and Wales law in these Terms does not deprive you of any mandatory rights or protections provided by applicable law which cannot legally be excluded.

15.4 Nothing in these Terms prevents a consumer from bringing proceedings in a court or jurisdiction where applicable mandatory law gives them the right to do so.

15.5 International Events. Events and services provided outside the United Kingdom may also be subject to mandatory federal, national, state, regional or local laws and regulations in the location where the service is provided.

15.6 Where an individual event agreement expressly specifies a different governing law or jurisdiction, that provision will apply to that particular agreement to the extent permitted by law.

16. Severability

16.1 If any provision or part of a provision of these Terms is found by a court or competent authority to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

16.2 Where possible, the affected provision will apply with the minimum modification necessary to make it valid and enforceable.

17. No Waiver

17.1 If we do not immediately enforce a right or provision under these Terms, this does not mean that we have waived that right or provision.

17.2 A waiver will only be effective where expressly agreed in writing.
